Maria Hernandez Case
MARIA HERNANDEZ VAN NESS TEAM 10 The Story: Maria Hernandez & Associates is a company that started its business with a cash deposit. On June 20,2004 Maria Hernandez transferred all her savings of $30,000 into a new Bank account under her companyââ¬â¢s name, two days later she transferred another $20,000 which she had borrowed from her father on a 6% p. a. interest rate. Thus, with an amount of $50,000 in its bank account Maria Hernandez and Associates was ready to start its life in the Webpage designing sector. After the Bank account transactions, Maria Hernandez quickly took care of the initial expenses that included pre-paid rent for the new office, giving a security deposit for the same, buying used computers and software from her previous employers and also ordering and acquiring office stationary. On July 2,2004 Maria Hernandez & Associates opened its doors for business. The substance of our report covers the first two months of the companyââ¬â¢s operations. At the start of the operations i. e.July 2nd, 2004 the amount in the company bank account was $12,000; however on August 31st, 2004 (roughly two months of operations) the amount had declined to $6,600. We are therefore left with two key questions to answer. 1. How would we report on the operations of Maria Hernandez & Associates through August 31, 2004? Had the company made a profit as Maria Hernandez believed? If so, how can we explain the decline of cash in the bank? 2. What can we say about the status of the business on August 31, 2004?To answer these questions we analyzed the companyââ¬â¢s income statement and balance sheet for the months of July-August, 2004 and have come up with the following analysis and suggestions: Financial Ratios: Through the analysis of the Income Statement and Balance Sheet, we were able to extrapolate the following Ratios, which gave us an insight into the workings of Maria Hernandez & Associates |Financial Ratio |Figures | |Current Ratio |4. 17 | |Return on Equit y |13% | Return in Assets |7% | |Profit Margin |9. 8% | |Debt to Equity |0. 74 | By and large, the ratioââ¬â¢s displayed are lower than ideal. However, given the fact that the operation is only 2 months old, the figures are very promising; especially since there was an increase in workload of the company in early August with four new clients by way of referrals. Considering all the ratios in more details we would like to start our analysis with ROE ratio that measures a companyââ¬â¢s profitability. We have 13% what means that the company is making 13 cents out of every dollar invested. This figure is relatively low, but for a start-up company it is rather satisfactory, because it indicates a growth opportunity with increasing operations. ROA ratio shows us how many dollars the company makes in relation to its assets, thus 7 cents per 1 dollar. The ratio is deceptive because by definition a lower ratio denotes inefficient use of assets. But considering a start-up that operates f or only 2 months, there is a scope for improvement since the number of operations has been increasing. In addition, this ratio can vary depending on the industry in which the company operates. This is why our suggestion to Maria Hernandez is to compare ROA every month in order to be able to realize how productive or unproductive the business is. Profit margin represents the percentage of revenue that a company keeps as profit after accounting for fixed and variable costs. In other words, it is companyââ¬â¢s health indicator. The company is keeping 9. 8 cents of sales as earnings for every dollar that the company earns. It is a good sign because the company was able to recoup the initial fixed costs and also showed a profit in the books within 2 months, on the other hand the usual trend for web-page design companies to show a profit is 1-2 years. Debt to equity ratio indicates extend to which the business relies on debt financing. As we know, Maria Hernandez borrowed $20,000 from he r father at 6% interest rate and invested $30,000 cash from her own savings. In addition, the company made revenue of $40,000 in cash that helped to cover all the expenses and operational purchases. So, we can conclude that the company is growing on cash mainly and in the tech industry this ratio is bound to go down, because once the assets [computers and software] are acquired there is no need to take on debt to grow the company, as the growth can come from the revenue itself. On an average computer companies have a Debt to Equity ratio of under 0. 5 Current ratio that shows the ability of the company to pay off its liabilities at a given period of time is the only point of concern. As a rule the acceptable figure is between 1 and 2, in our case we have 4. 7, what means that Maria Hernandez can pay off her loan with interest however, she has some excessive cash on hand what indicates inefficient management of funds. Suggestions: We would first like to address the matter of treating the Interest and Depreciation. The interest is accumulating and since the interest has to be paid at the end of the year, the amount at the moment is incomplete. Therefore, the interest payable should be accounted in the Balance Sheet, and interest expense in the Income Statement. In case of the equipment, accumulated depreciation is to be taken into consideration. The depreciation per month is $750, thus the accumulated depreciation is $1500 after 2 months of operation. As the expected life of the equipment is 3 years Maria Hernandez should credit the accumulated depreciation for 1/3 of the value of the assets, subtract accumulated depreciation from the equipment in the Balance Sheet and include depreciation expense in the Income Statement. An analysis of the Expense to Income ratio showed that currently 86% of the income is being used to write off expenses such as rent and salaries, which explains the decline in the bank balance as on August 31st.We recommend reducing such expenses by keeping fewer full-time staff and hiring interns or keeping staff on a part-time basis at least for the initial period of the companies life. Conclusion: In conclusion we would like to say that Maria Hernandez & Associates is doing rather well as a Start-up company. The numbers are mostly in its favor, and are bound to get better as the life of the company progresses. The only flaw in the design is by way of the expenses incurred in form of Salaries, which can easily be fixed.

Explore the Way Poets Portray Love in La Belle Dam Sans Merci with Reference to 5 Other Poems
Core Texts: La Belle Dame Sans Merci. A Ballard ââ¬â John Keats Sonnet 116 ââ¬â William Shakespeare My Last Duchess-Ferrara ââ¬â Robert Browning Illumination Texts: Sonnet 18 ââ¬â William Shakespeare Valentine ââ¬â Carol Ann Duffy Porphyriaââ¬â¢s Lover ââ¬â Robert Browning In the above poems love is presented in 3 very different ways, twisted and false love, typically romantic forbidden love, and unchanging love. Twisted and controlling love is a theme that can be seen in some of Robert Browningââ¬â¢s poetry. My Last Duchessâ⬠is a dramatic monologue written in 1842 by Robert Browning. It is written in 28 rhyming couplets, with iambic pentameter, which dominates the poem. The conversational flow of the poem is created by making caesura and enjabment. The enjambed lines may indicate control that the speaker is exerting on the conversation and give the feeling that the speaker is rushing through parts of the poem, possibly smimming over the parts the show him in a unflattering light. When the Duke speaks of the death of his wife, for example, the lines running over suggest that he is nervous about the subject and is nervous of whether he is revealing too much about his envolvement and the caesuras also suggest to the reader that he is hiding something or that he is pausing to carefully think about his phrasing. However, perhaps on reflection, he then boast of his envolvement in line 45 ââ¬â ââ¬Ëi gave commandsââ¬â¢ possibly showing his character as fake and mysterious, untrustworthy. We know that the Duchess died suspiciously and that the Duke is in the process of looking for a new wife, and suggesting he disposed of his old one. He is speaking to a messenger about a painting of his now deceased Duchess. The Duke, of course, is casting himself in a favorable light and is presenting his best side. He wants to make it look as if his wife was cheating on him and was unfaithful to him, showing he is not trust worthy. He is v ery controlling, and could not control her and her smiles or looks ââ¬â line 24 ââ¬â ââ¬Ëtoo soon made glad, too easily impressedââ¬â¢.This smile was what the Duke likes the most about the painting of the Duchessââ¬âhe feels that the painter accurately captured the smile and the ? ââ¬Ëspot of joyââ¬â¢ in the Duchess. Now that the Duke owns this painting and has placed it behind a curtain, he can at last control who is graced with her smile. ?à à à à When the Duchess was alive, the Duke could not control her smile and love for life and he considered her unfaithful. Other aspects of the Duke that remain unclear include his true character and his true feelings for the Duchess, whether he really ever loved her or not, remain unknown. As mentioned, he is presenting his best side, but through his speech the reader sees how he is very jealous and controlling, which leads one to believe that he may have many dishonorable qualities. With such a negative descri ption of the Duchess, suggesting she was unfaithful and lacking in refinement, it raises questions about the Dukeââ¬â¢s true feelings for the Duchess. This is where the idea of twisted and false love. We question whether the Duke ever loved the Duchess or whether she was just another object for him to control and toy with for his own personal enjoyment and not becasue of true love for his wife. This twisted and somewhat controlling love can be seen in another of Browningââ¬â¢s poems. In both Porphyria's Lover and My Last Duchess, Browning describes a man who responds to the affection of a woman by controlling and ultimately killing her. Each monologue offers the speakers' reasons for his actions towards the desired woman from subject to his object. For example, we have already seen in My Last Duchess, the Duke may have murdered his wife out of jealousy, but decides to keeps a portrait of her behind a curtain so none can look upon her smile without his permission.Similarly in Po rphyria's Lover, the man wishes to preserve a single perfect moment between himself and Porphyria and so he kills his lover and sits all night embracing her carefully arranged body, as to enjoy the control he used to preserve the moment. In Porphyriaââ¬â¢s Lover the man seems to become convinced that Porphyria wanted to be murdered, and claims ââ¬Å"No pain felt sheâ⬠while being strangled, adding, as if to reassure himself ââ¬Å"I am quite sure she felt no pain. â⬠Sonnet 116 portrays a stark contrast to the twisted and controlling love of My Last Duchess. The main theme of this poem is unchanging love, that love can weather any storm and overcome adversity. The sonnet comprises of 3 quatrains with a new thought at the start of it, with a couplet at the end. each idea in a quatrian is linked, with the help of the steady ABAB rhythm, however it is kept fresh and light with the inclusion of halft rhymes. Sonnet 116 is about love in its most ideal form. It is praising th e glories of lovers who have entered into a relationship based on trust and the understanding that trials and tribulations are a part of relationship. The first four lines reveal the poet's pleasure in love that is constant and strong, and will not ââ¬Å"alter when it alteration finds. â⬠It describes love as it ââ¬Ëlooks on tempest and is never shakenââ¬â¢ meaning that no matter what life presents, love can and does remain strong. it enstills a hope in love and relationships. The poet goes onto proclaim that true love is indeed an ââ¬Å"ever-fix'd markâ⬠which will survive any crisis. Through to line 10 we see the poet explain the physical changes that can occur suring relationships, but reassures that ageing, death and physical appearance will not phase death, descrbing love as a ââ¬Ëbending sickleââ¬â¢.The remaining lines of the third quatrain (9-12), reaffirm the perfect nature of love that is unshakeable throughout time and will remain so ââ¬Å"ev'n to t he edge of doomâ⬠, ie death. It also points out that those who find true love, donââ¬â¢t realise how much enrichment. The poet reminds us that loveââ¬â¢s ââ¬Ëworth [is] unknownââ¬â¢, meaning that love can give you strength you never had or knew existed. In the final couplet, the poet declares that, if he is mistaken about the constant, unmovable nature of true love, then he must take back all his writings on love. Moreover, he adds that, if he has in fact judged love inappropriately, no man has ever really loved, in the ideal sense that the poet professes and that his words are untruthful. This sonnet does not use as much romantic and poetic language as some of his othger sonnets, for example Sonnet 18. The reason for this, is to symbolise the reality of a relationship. sometimes it isnt always chocolates, roses and romantic poems. Often true love and real relationships has ups and downs, but one resounding idea is that features in this sonnet is that true love isnâ â¬â¢t easy, but ââ¬Ëalters when alteration findsââ¬â¢ and ââ¬Ëis ever fixedââ¬â¢.Valentine by Carol Ann Duffy, like Sonnet 116, is a poem that portrays love in its rawest form, without the extraneous poetic gestures of love, and instead focusing on a realistic view of love and its hinderances. In the poem Duffy suggests these normal, cliched gestures of love are meaningless and instead gives her lover an onion instead of a rose ââ¬â ââ¬ËI give you an onion'. Duffy looks at the ways an onion is suitable for showing love. She tells her lover what an onion will do for him and uses the onion as symbol. The onion could represent patience, discovery and tears. The onion represents the tough side of love and the truth about love. The demure and almost humble description of the onions outer skin described as ââ¬Ë the moon wrapped in brown paperââ¬â¢ evokes the idea that love may seem boring when you first experience it, but if you take the time to look beneath the so calle dboring exterior, there is a inner beaty and radiance. This is realised with the word ââ¬Ëlightââ¬â¢, referrin to moon light. The imagery used in this poem is poetic, yet still holds true to the style of Sonnet 116, ie realism. The moon, may promise light ââ¬â but doesnââ¬â¢t always deliver.Duffy appears to be warning of trusting too much in the promises of romantic partners. ââ¬ËThe careful undressing of loveââ¬â¢ may reveal a personââ¬â¢s true character and motives under the veneer of romantic vows, again critising the cliche romantic type. ?The poet goes on to cleverly create an image of tear-filled eyes ââ¬â ââ¬ËIt will blind you with tears like a lover. It will make your reflection a wobbling photo of grief. ââ¬â¢ Here she refers to the stinging, burning properties of onions, using a technique which causes readers to try and visualise seeing through tear-filled eyes by the use of language such as ââ¬Ëblind,ââ¬â¢ ââ¬Ëtears,ââ¬â ¢ ââ¬Ëreflectionââ¬â¢ and ââ¬Ëwobbling. These words all evoke memories of trying to view images through tears. She likens stinging hurts caused by insensitive loves and the blurred vision and sore eyes caused by crying and emotional pain to those created by an onion. La Belle Dame Sans Merci. A Ballard is portyas perhaps the most classically romantic type of love. Often passionate, poetic and short lived, this type of love is well represented in this poem, although it does have many interpretations. The style and language of the poem is very romantic, while theme can be interpretted as forbidden love.In the poem a young knight meets a beautiful woman, who is so described as ââ¬Ë a faeries childââ¬â¢. This description immediately gives us the impression that this young woman is not of the mortal world. There are many stories surrounding relationships between mortals and immortals, and they are often thought to be forbidden. The barrier between these two worlds often l eads to unhappiness as the immortality of one partner creates problems in the relationship in many myths for example Persephone and Hades. The first glimpse we get that the relationship between the knight and the fairy may be forbidden is when the poet says ââ¬Ëshe wept and sighed full soreââ¬â¢ ââ¬â line 30. It is possible that the fairy is weeping as she knows the realtionship is doomed from the start, that the couple cannot stay together, as the crossover between mortal and imortal world is precluded. She may be powerless to stop the fate of the knight, and is feeling guilty for what she imposed on the knight. As the fairy is unable to help him escape his fate, she tries to comfort him as best she can, ââ¬â line 33- ââ¬Ëand there she lulled me to sleepââ¬â¢. As he sleeps the knight is shown the fate of a man like him, one who has had this fate placed upon him. he is not quite sure if it is a dream, or if he has entered his fate, shown by the constant switching o f scenery, from lakeside to hillside -lines 40-44. This dream like state relays back to the romantic love and the idea of dreams, beautiful fairies and other worlds were all romantic ideas, common at the time. This romantic, poet desciption of the knights lover, scenery and dreams are not dissimilar to one of the most famous sonnets. In Sonnet 18 the poet begins by asking whether he should compare ââ¬Å"theeâ⬠to a summer day. He says that his beloved is more lovely and more even-tempered. He carries on, saying that everything beautiful eventually fades by chance or by natureââ¬â¢s inevitable changes. Coming back to the beloved he writes about, though, he argues that his or her summer wonââ¬â¢t fade nor will his or her beauty fade away. Moreover, death will never be able to take the beloved and concludes that as long as humans exist and can see, the poem will live on, allowing the beloved to keep living as well. This poem is has the classic romantic and poetic language, th e best instance being the comparison of the subjects beauty to the transient beauty of nature, as the lady in La Belle Dame Sans Merci, is described in realtion to nature. However the poet goes on to argue that the subjects beauty is the opposite to natures, as summer can be too hot and short etc ââ¬â ââ¬Ësummerââ¬â¢s lease hath all too short a dateââ¬â¢.

E-commerce and Information Systems Essay Example | Topics and Well Written Essays - 250 words
E-commerce and Information Systems - Essay Example The sampled secondary data retrieved from the E-commerce and information systems scholarly journals were then analyzed using a number of the formulated research hypothesis, which is used to weigh the qualitative agreement or disagreement of the retrieved scholarly journals on E-commerce and information system matters. The results from the research analyzes are used to draw inferences drawn from the hypothetical juxtaposition of the scholarly argument and concurrence on the interaction between E-commerce and information systems together with the impact of the postulated interaction of a business as a whole. These inferences are then used to reaffirms or refutes the thesis about the functional correlation between E-commerce and information systems. The inferences are also intended to reaffirm or refute the research position of an information systems dependent E-commerce (Wymer & Regan 2011, p 27). Finally, the inferences are used to establish the level of advancement of information sys tems employed in e-commerce, which in turn determines their safety or vulnerability to exploitation for malicious damage of a business. The research addresses the question of the functional correlation between e-commerce and information system as a novelty subject in business management and marketing (Grand, Mykytyn & Nascob, 2011, p 18). It also provides a hypothetical framework for research in e-commerce and information system in the context of organizational management and marketing. Wymer, S. and Regan, E. A., 2011.Ã

Measurement of Blood Pressure Essay Example | Topics and Well Written Essays - 750 words
Measurement of Blood Pressure - Essay Example the systolic blood pressure or the blood pressure when the heart is contracting and it also reads the diastolic blood pressure or the blood pressure when the heart is relaxing. The systolic blood pressure is therefore also the highest pressure exerted by the blood and the diastolic blood pressure is the lowest pressure exerted by the blood. Before the blood pressure of the patient is taken, the nurse must first gather as much information from the patient as possible. Relevant information includes the patientââ¬â¢s age, gender, weight, and such other pertinent information like the patient history of cardiovascular diseases; hypertensive medications, and if at the time his blood pressure is about to be taken if he is tired or has been physically fatigued. These elements often affect blood pressure reading, indicating it to either be too high or too low. Moreover, normal blood pressure ranges are different for every patient depending on age or current history of heart diseases and hypertension. After establishing the information as mentioned above, the nurse must now prepare her equipment. This would include the aneroid or the mercury sphygmomanometer, the stethoscope, a chair where the patient can sit, and a table where the sphygmomanometer can be placed. The table and chair must be placed in close proximity to each other to ensure that the patient can lay his hand on the table near the sphygmomanometer. The sphygmomanometer has a cuff which is wrapped around the patientââ¬â¢s upper arm; it inflates with air from the air valve. The sphygmomanometer also has a rubber tube connecting the cuff to the air reservoir or to the mercury meter. Such tube is also connected to a rubber bulb which is pumped in order to fill the cuff with air. Before taking the patientââ¬â¢s blood pressure, the nurse must remind the patient to keep still and to be quiet.Ã
The Syrian Civil War and the Regional Stability Essay
The Syrian Civil War and the Regional Stability - Essay Example Bashar al-Assad revealed to the citizens that he will abolish the party after he entered into power, in 1970 (Hirsch 35). However, he never abolished the party, but rather transformed it. Assad structured the Baââ¬â¢ath party in order to make it fit in the dictatorial format of his presidential regime. The Syria government deployed the Army in order to control the Syrian uprising and they ordered soldiers to control and take action on any public protest. However, the demonstrations evolved later into a serious armed rebellion and some of the groups became armed terrorist. These created the commotion and crushes across the nation; thus impacting the regional stability of the Syrian nation. Thesis: Despite the political issues of the Assad dynasty and unapparent end of Syria crisis, politicians have emerged with political agendas regarding the way they can solve the political impact of Syria civil war on the regional stability of Middle East. Impact of Syria Civil War on the Regiona l Stability of the Middle East The Syria Civil War has contributed to varied impacts on the regional stability of the Middle East. First, the Syrian uprising is a threat to socio-economic development of the Middle East. ... The Middle East has become the home for multiple ethnicity and religious conflicts including the Kurds, Muslims, Arabs people, Christian community, Assyrians and many others. The conflicts has been sparkled by the Syrian Civil War; thus creating national disasters in the Middle East. Activist claims that more than 30 000 Syrians have lost their lives while others have lost their properties in the Syria uprising, which started on March of 2011 up to the present (Handler 42). This, many people from these regions have economically and politically felt the impact of the instability in the Middle East economies. Secondly, the harshly domestic war in Syria has contributed to local displacement and international isolation of many people. The international isolation revealed some signs of lessening after France and Russia made significant efforts of bringing the issue of Middle East conflicts back to the international fold. However, the Syrian violated the UN verdict that led to the banning of Lebanese militia, which also contributed to the annex of US sections on the war issues. The debate is now on the way US can respond to the escalating Middle East crisis that have led to increased internal displacement of many people. The IDPs have increased because Syrian uprising has impacted the stability of the Middle East economies; hence causing heavy constraints on the economic resources of Middle East economies. The Syria war has tremendously contributed to refugee problems and the internal displacement of people is further expanding. The expansion and settlement of the U.S Essay Example | Topics and Well Written Essays - 250 words - 2
The expansion and settlement of the U.S - Essay Example However, this process of incorporation and inclusion of territories that had not previously been part of the United States was not something that came about on its own. Instead, it was encouraged by the government, by the press, and by individuals within the United States as something of a ââ¬Å"manifest destinyâ⬠. As this confusing phrase implies, the destiny was that the United States was predisposed to conquer and occupy all of the territory between the Atlantic and Pacific, stretching all the way to Mexico in the South and all the way to Canada in the North. The primary rationale for this manifest destiny was that God had given the United States a unique opportunity and all of the lands that it was to occupy. Naturally, this particular rationale is reminiscent of the way in which the God of the Old Testament had given the land of Canaan to the Israelites as immutable; upon their exodus from Egypt. In terms of defense ability, this particular rationale is of course completel y and entirely indefensible. None of the individuals, whether members of the press, members of the government, where members of the individual society, has spoken with God and were able to definitively conclude that this is what you want. Furthermore, such a behavior trampled upon the rights of indigenous peoples and those that had otherwise laid claim to the regions that the United States slowly incorporated into the

MBA - Critical Thinking and Decision Making Essay
MBA - Critical Thinking and Decision Making - Essay Example This forms the basis of arguments in critical thinking, an aspect that is the backbone of the process. According to Ford M. the issue that is of concern is privatization of the information system management (ISM) function by the current governor. According to the governor, the move would lead to the state saving approximately $250,000 annually. Privatization would involve outsourcing of similar services from either a local or foreign company, and would enable the state save some amount that would go into providing same services (Ford M. Personal communication, January 30, 2012). Step 2 The Reason The reason in this memo is that the proposed transition would save the state about $250,000 annually. This would be the extra amount that the personnel would be paid for the whole year. Privatization would ensure that a given company is given the responsibility to provide the same services as those provided by the current employees. In addition to this, state would still manage to save about $250,000 per year that would be used for other purposes. This seems a viable idea that the state would go for as it would be profitable in the long run. Supporting this is that the government or the state would provide its employees in the company with ââ¬Å"similarâ⬠posts in other departments within the state. Step 3 Ambiguous Phrases An ambiguous phrase has no supporting evidence and may be just a claim. In her discussion, she used the phrase, ââ¬Ëan attempt to drive out experienced workersââ¬â¢ which she does not support with evidence. This is just a claim and would not be true unless supported by evidence. Another term used is,ââ¬â¢ most likelyââ¬â¢. This simply shows that an occurrence has higher chances of occurring but has not been confirmed to occur. There is no certainty when the writer says that most likely their members would be out in the streets with no jobs. She says that outsourcing, public services to private companies would cause ââ¬Å"instabili tyâ⬠. This is ambiguous because she does not explain how it would cause instability within the state. Again, one company such as the one mentioned would not be the one controlling the whole economy. Therefore, this would still be a claim with no evidence to give support. All these terms are used for the main purpose of convincing the union members not to agree with the governor. Her aim is to gain support from the union members by supporting facts with unclear evidence for the purposes of personal gains. Step 4 Value Conflicts and Assumptions This would be indicated by the idea of offloading people who worked in qualified position within a firm. Conflict comes up when the state retrenches individuals or offloads them and assigns others to carry out their work. This would be by outsourcing from even outside the countries or foreign countries. This would not be ethical because a state would be denying its citizen an opportunity to work at an expense of making savings by the use f oreign countries. This indicates that such a country does not even care for its own citizens. This would be because such a country would be giving privilege to outsiders in preference to its citizens. The main reason for this action would be that there would be saving to be made to the state. Again, there is an assumption that attrition would occur within other government departments that would result in arising of work

Harts version of legal positivism and Dworkins attack of Harts Essay
Harts version of legal positivism and Dworkins attack of Harts particular version - Essay Example Also associated with positivism is the discretion thesis, which describes the fact of judicial decision as such: when there are gaps left by legal rules (i.e., in the so-called ââ¬Å"hard casesâ⬠), judges make new laws in the exercise of their discretion. This emphasis on the part played by judicial discretion when courts have to decide open questions of law runs through positivistic jurisprudence from John Austin to H. L. A. Hart. The positivist discretion thesis has, however, been challenged by theorists like Ronald Dworkin, Rolf Sartorius and others. This paper explores the arguments of both the positivist and non-positivist camps and discusses whether an acceptance of the positivist thesis will cause one to adopt a different outlook with regards to the judicial process in hard cases. Due to space constraints, this paper focuses only on Hartââ¬â¢s version of legal positivism and Dworkinââ¬â¢s attack of Hartââ¬â¢s particular version. These two theorists are chosen be cause of the prominence of the Hart/Dworkin debate. Part II of the paper summarises the ideas of Hart. Part III provides an explanation of Dworkinââ¬â¢s attack on legal positivism. Part IV then moves into an analysis of whether adopting a positivist outlook will make a difference as to how one views the process of adjudicating hard cases.

Careers in Psychology; Opportunities in a Changing World Essay Example for Free
Careers in Psychology; Opportunities in a Changing World Essay It is usually very vital for one to consider the choice of their career path very carefully. One should consider his or her interests in the career, the job market as well as their education qualifications. It is equally important for one to carefully examine the merits and demerits that come with each career option. This is the sole reason why career talks have become part of the school curriculum in many countries in the world. This paper will analyze three case studies of individuals who are about to complete their Bachelorââ¬â¢s Degrees in Psychology, after which it will critically analyze the options the three cases have laid on the table by analyzing the advantages and disadvantages of each. Denise is considering a couple of options; Master of Arts/ Master of Science in Clinical Psychology Master of Arts/ Master of Science in Counseling Psychology Master of Education in Counseling Psychology Master of Social Work Master of Science in Pastoral Counseling Master of Science in Counseling. Important to note is where the interests of Denise lie. She has an interest in reading research materials or findings related to children, however this interest is not that much. Denise is also not very interested in doing research work. Considering the fact that Denise has a passion in desire to counsel youth and children is not enough when deciding to choose the next degree program the best option for Denise would be a Masterââ¬â¢s Degree in Pastoral Counseling. The merits of this program are that it is in all ways related to the interests of Denise. It would give Denise the best opportunity to counsel youth and children. The degree does not require a lot of research work, rather it r equires more of reading research work. This would by all means be the best for Denise. However, a Masterââ¬â¢s Degree in Pastoral Counseling would be tricky if matters of spiritual faith are put in consideration. It is not clear where her faith lies. It would be unbeatably the best if her spiritual faith lies along the pastoral line, or if she had pursued a degree in theology. CITATION Tar12 l 1033 (Kuther, 2012)A Masterââ¬â¢s Degree in Clinical Psychology would be advantageous in the sense that it has a wide job market and it is in line with the passion of Denise. However, this degree would not be the best for Denise since it requires a lot of research, which Denise is not very good at. Another disadvantage of this is that it would not limit her exactly to youth and children the way she would like it, older people have psychological problems as well. A Master of Science in Counseling Psychology would also not be advisable for Denise. This degree, just like the one in Clinical Psychology would require a lot of research work. Denise does not like research work and it would be very difficult for her to excel in this program. However, it could be really advantageous in the sense that it requires reading research materials and this is one major stronghold for Denise. A Master Degree in Clinical Psychology would have the same limitations as a Master Degree in Counseling Psychology. However, she loves reading research materials on youth and children. This would favor her in the case that she chose this career path. This leaves the best option for Denise as a Master Degree in Pastoral Psychology. CITATION Rob07 l 1033 (Sternberg, 2007)It would be very difficult for Raul to change what he wanted to do all his life to something else. However, the policy when choosing career paths is always no mistakes. This is when the purpose of internship comes out very clearly. All his life, Raul has been interested in counseling psychology or clinical psychology. He should be very careful when making a choice for the nest career step. This is owing to the fact that for one to excel in a certain career path, he or she ought to have the desire and passion for it. Passion does not just grow within a day and Raul does not have much time to make a decision. However, the volunteer work that he did in the psychiatric clinic seems to have helped him a great deal. The interview that he had with counselors and psychologists seems to have opened his eyes to the real career world. It is very important for Raul to make a decision before it is late since he is about to graduate from school. The interests of Raul are very important is deciding his career path. The fact that he has a wife and children makes it very necessary for him to take a career path that would help him a great deal financially. The best option for Raul in his career path would be to pursue a Masterââ¬â¢s Degree in Counseling Psychology. This is owing to the fact that he has interests in researc h which is very vital to the program. Moreover, counseling would give him a wider job market and would therefore sustain him financially. CITATION Don08 l 1033 (Super, 2008)Having been in the cooperate world is indeed a milestone for John in the career world. As much as he was laid off, he is way ahead of a number of individuals. His experience in the cooperate world must have equipped him with a number of skills that will help him a great deal I n future. This is considering the fact that he would love to integrate his career path of psychology with business. For instance, one of the options that John is laying on the table is Industrial Organizational Psychology. I could not agree more with John on this one. Industrial Psychology would indeed be a very good way for John to combine what he learnt in the cooperate world together with Psychology. However, John should always keep in mind that this is a competitive world. The field of Industrial Psychology is just one of the fields tha t experience a lot of competition when it comes to pursuing a graduate program in the field. However, the best advice for John would be to first of all take a professional course that is related to business or rather the cooperate world. Such courses include Business Management, Business Administration, Marketing or even Certified Public Accounting (CPA). In this way, he would be able to prove his skills in the cooperate world, not just by word of mouth or experience but by Certified Professional Courses. This, together with a Bachelorââ¬â¢s Degree in Psychology would raise his bar much higher. Having done any of these professional courses, John would not only be fit to pursue Industrial or Organizational Psychology but he would also be able to compete with other individuals. Customer As Benefit A Positioning Strategy Marketing Essay
Customer As Benefit A Positioning Strategy Marketing Essay Positioning is to make happy consumers to perceive products and services and what strategies marketing adopt to reach this perceptual goal. Positioning strategies is very important for business in marketing sector. It can be performed from the object attributes, competition, application and the types of consumers involved, or the characteristics of the product class. All these attributes convey a separate direction in developing positioning strategies; it can create a favorable image in the minds of the consumers or audience. There are seven approaches to positioning strategies: 1. Using Product characteristics or Customer as benefit a positioning strategy: Product characteristics strategy originally focuses upon the characteristics of the product or customer benefits. Product characteristics can be durability, economy or reliability. Product quality is the main subject in this strategy. 2. Pricing as a positioning strategy: In this strategies depend on products quality and price. People want to get good quality in cheap price. 3. Positioning strategy based on Use or Application: When companies produce a product, in the same time they have to think about its alternative product. They need to make seasonal product also. 4. Positioning strategy based on Product Process: Product can be different by people choice. It depends on different types of fashion. Here same products need to present various ways. Positioning strategy based on Competitors: In this type of positioning strategies, Companies are trying to stay in the market they try to make new brand as they can continue in the market and they can face other competitors. This strategy adopted because of competition. For every company positioning strategy is very effective. Every company should follow this strategy for their business. In the XCITE church, they could follow the 7 steps of positioning strategy. But they did not maintain positioning strategy. As a result the church could not afford to employ a full-time pastor and the church depended on volunteer workers. Unique positioning: Creating of awareness for a business, not-for-profit institution or association doesnt begin or finish with a mission statement. In fact, legation statements are a waste of time in todays world because they are singularly inward-looking and useless. Consciousness comes from a single peculiar positioning message that stimulates a conversation, and a spirit to know more. For unique positioning a unopposed and coercive positioning message is necessary because it sets apart from other competitors. To be successful, Companies must focus on one thing and be the best at it. The part of church service is to spread their service to people and welcome them to church. To increase churchs member and becoming more integrated within community, the following information may be of some help. Though by no means exhaustive, these are techniques that have worked for churches in the past, and which may work for community, as well. A Clear statements Make sure that convention has a clear statement of faith and the role it wants to take on in the community at large. A clear statement can help to find new member for community, and can help to draw new members to the church. The affection and compassion of Christ are endless, and endlessly shareable through community and brotherhood. It can help to make strong community. Charity Work The churchs services are involved with charity work. The church service is a great way to become more involved with the community. Try to make the church a resource for people who are interested in helping their community, whether theyre Christian or not. Gather information about them who are interested in charity and volunteer work. Community Events Community events are significant path to engage with the society and make neighborhood at the society. Youth Programs Young people can do any hard job easily. Teenagers are very curious about anything. Hiking, Skiing, and rock climbing trips, battles of the bands and camping retreats all provide opportunities for the youth nearest the church community to invite their friends of other faiths from the community at large to join in activities of friendship and togetherness. Working with other Religious Organizations working with other religious organizations can help to make partnership and friendship. Reach out to make friendships with church leaders of other denominations and faiths. Communication is often the first step creating a stronger and more unified neighborhood at the community. People in Need Some times church provides social services such as addicted and homeless people often receptive to spiritual guidance in a practical form. Also, single parents, in particular, are often in need of support and advice from their community, and your church has the opportunity to take a major role in the lives of such people and their children. The XCITE Church cannot maintain its unique positioning in the high competitive church market because the church had not enough resource to run their services properly. They had no full time pastor and also no musicians. The XCITE church had not own venue for their weekly services and run under a volunteer pastor. The church depends on international students and facing financial problem also. To continue churchs activity they need strong financial base but they had not enough wealth. On the other hand, other churchs had huge space for their weekly services and they added new services continuously to their menu. They added new food item on their food menu. The XCITE church had not unique positioning to run their services in the highly competitive church market. Reference List: Positioning Strategy. 2012. Positioning Strategy. The key challenges faced by XCITE church The XCITE church faced some challenges. The first challenge was financial crisis. They could not spend more money for its operating cost. They had not own venue so they had to rent venue for their weekly services and the church spent huge money on its promotional materials. Church had to struggle for covering the operational cost. Most of the church members are student thats why they could not donate properly to the church. They had to depend on non members for their church activities. As church had financial crisis so they could not employ a full-time pastor. They dependent on volunteer pastor but weekdays he was not available at all. The pastor could not obey his duty properly. Members could not meet pastor when they need so some members were leaving the church. As a result the quality of churchs service goes down. During exam time student cannot co-operate properly due to their study loads also semester break same happened on the church. The XCITE church had limited element such a s pastoral care, hospitality and music systems. So the people cannot attend to their churchs ministries. Other main problems are to face XCITE church that is in the church-business they had competitors at the same area. Other competitors had huge space and many facilities. XCITE church caters for only university students but other church can arrange cater for families, students, elderly and children. To overcome from this key challenges XCITE church can apply SWOT analysis system. SWOT analysis system SWOT stands for strengths(S), weaknesses (W), opportunities (O) and threats (T). An overview of the four factors (Strengths, Weaknesses, Opportunities and Threats) is given below- Strengths Strengths are the abilities that enable to accomplish to the organizations target. Strengths can be tangible or intangible. These are what well-versed in or what expertise in the organization, the attachments and qualities individually or team and the distinct features that give to organization for its patience. Strengths are the beneficial appearances of the organization or the efficiencies of an organization, that includes process capabilities, human competencies, products and services, customer goodwill, financial resources, and brand loyalty. For the examples of strengths are broad product line, huge financial resources, no debt, committed employees, etc. If XCITE church can manage its financial condition they could solve the problem. The church had not enough money thats why it faces problem to maintain its operational cost. Weaknesses Weaknesses are the abilities that prevent from accomplishing to the mission and achieving its full potential. These weaknesses collapse influences on the organizational success and growth. For weaknesses of an organization may be faced depreciating machinery, insufficient research and development facilities, narrow product range, and poor decision-making problems. Weaknesses are manageable. Weaknesses must be minimized and eliminated form organization. The church had not full-time pastor. XCITE church had not enough materials. They depend on students only. Opportunities Opportunities are dedicated by the environment within an organization operates. Opportunities are arisen when an organization planning to increase its business range in this situation employ can take benefit of conditions in its environment to plan and execute strategies that enable it to become more profitable as they can prove their ability. Organizations also can gain competitive advantage by making use of opportunities in their farm or industries. Opportunities may emerge from industry/market competition, government and technology. Increasing demand for service opportunities may be arise and employ can prove their skills to the authority. If the XCITE church could accept people from their community and arrange competition to young people who wants to work as volunteer worker for the church could make opportunities for young eople. XCITE church could add some opportunities to their volunteer workers. Church could add cater for families, students, elders, children. They can arrange Sunday school for kids and nice music also. Threats When a company or organization established in their own business and getting more profit then threats-Threats may arise. Threats are uncontrollable. Any times it can create for business. When a threat comes, the durability and uplift can be at stake. For the examples of threats are increasing competitions leading to excess capacity, unrest among employees, changing technology, price wars and reducing industry profits, etc. XCITE churchs main threats are other huge church and their special services. SWOT Analysis take steps about information that helps in the firms resources and capabilities with the competitive environment. If XCITE church applies SWOT analysis to its operation it can solve its all limitations. It will be effective for XCITE church. The SWOT analysis is a valuable step in church situational analysis. Assessing churchs strengths, weaknesses, market opportunities, and threats through a SWOT analysis is a very simple process that can offer powerful insight into the potential and critical issues affecting for church. If I would the pastor of XCITE church I would follow the first strategic option. I would continue focusing on university students because I believe Young people can do everything. They have energy to do hard job and they are fresh. To find additional sources of income I would apply marketing mix strategy. To face the challenges I would apply extended marketing mix known as 7 ps. Marketing mix Marketing mix strategyà is about achieving marketing objectives through proper analysis of the 7 Ps or elements of marketing. 7 Ps are: Product XCITE churchs product is their service. Everyday church should add extra offer and need to compare services with other churchs service. Product should be significant from others product. Church should offer its products or service at all in the current market place. Prices The second P in the formula is price. Develop the habit of continually examining and reexamining the prices of the products and services church sell to make sure theyre still appropriate to the realities of the current market. Sometimes church need to lower prices. At other times, it may be appropriate to raise its price. Many companies have found that the profitability of certain products or services doesnt justify the amount of effort and resources that go into producing them. Occasionally churchs needed to change its terms and conditions for sale and need to package sale. Promotion The third habit in marketing and sales is to think in terms of promotion all the time. Promotion includes all the ways to tell customers about the products or services and how market and sell to them. Only for promotion sale can be raised dramatically. Even small changes in advertising can lead immediately to higher sales. For publicity posters and lift let can be distributed. Place The fourth P in the marketing mix is the place where the product or service is actually sold. Develop the habit of reviewing and reflecting upon the exact location where the customer meets. The XCITE churchs need specific place for its weekly program. As they can rent this place for various purpose. People People are an essential ingredient in service provision; recruiting and training the right staff is required to create a competitive advantage. Customers make judgments about service provision and delivery based on the people representing in an organization. This is because people are one of the few elements of the service that customers can see and interact with. Process This element of the marketing mix looks at the systems used to deliver the service. Imagine. An efficient service is needed to make faster process. How quickly and better services they can be provided. Physical evidence Physical evidence is about where the service is being delivered from. It is particularly relevant to retailers operating out of shops. This element of the marketing mix will distinguish a company from its competitors. Physical evidence can be used to charge a premium price for a service and establish a positive experience. All the church provide same service but need to know about their charge and neat and clean environment. Marketing mix for a service has additional elements because the characteristics of a service are different to the characteristics of a product. To certain extent managing services are more complicated then managing products, products can be standardized, to standardize a service is more difficult as there it can be affected by factors outside the service providers control. If I would the pastor of XCITE church I would apply this marketing mix to my church for additional source of income. I think this strategy would be better option for the church.

HRM contributions to an organisation
HRM contributions to an organisation Human Resource Management (HRM) is the function within an organization that focuses on recruitment of, management of, and providing direction for the people who work in the organization. Human Resource Management is the organizational function that deals with issues related to people such as compensation, hiring, performance management, organization development, safety, wellness, benefits, employee motivation, communication, administration, and training (http://humanresources.about.com) In a short way to say about HRM is putting the right people to the right task and vice-versa to get the maximum output for an organization in a process. The people/workforce is represents one of its most potent and valuable resources in any organizations. In this assignment I am going to discuss Human Resource Management (HRM) how (HRM) contribute the Three HR policies across two diverse organisations. How an organisationà ¿Ã ½s structureand culture contribute to HR performance Evaluate HR policy in a given organisation. Organisations. Asda ASDA is a British supermarket. Asda provide a service to their consumers. There service consists of providing their customers with food, clothing, toys, electrical appliances and general merchandise. They also have a mobile network, called Asda Mobile. Their main rivals in this sector are Tescos, Marks and Spencers, Morrisons and Sainsbury. Asad have more than 143,126 employees. (www.asda.com.uk). Sainsburys Sainsburys PLC is a major retailing supermarket based in England. Sainsburys provide a service to there consumers. There service consists of providing there customers with domestic grocery and in many store electrical appliances such as television, DVD players and many other electrical appliances. There main rivals in this sector are Tescos, Marks and Spencers, Asda and Morrisonà ¿Ã ½s. Sainsburys have more then 758 stores including local Sainsburys. Task 1 Three HR policies of Asda and Sainsburys 1. Recruitment and selection 2. Training and development 3. Employeeà ¿Ã ½s relation 1. Recruitment and selection: Recruitment is defined as à ¿Ã ½practices and activities carried out by the organisation with the primary purpose of identifying and attracting potential employeesà ¿Ã ½ (Barber, 1998). At Asda, the objective of recruitment and selection is to attract and recruit the right person, with the attitude while maximally utilising the available resource at its disposal. Asda has a policy set to bring in the best candidates to fit a particular post. The process described is applied in my organization and this process begins with the identification of a vacancy to the process where the actual person fit for the job is found. Sainsbury has a policy set to bring in the best candidates to fit a particular post. The process described by of Atkinson J (1984) is applied in my organization and this process begins with the identification of a vacancy to the process where the actual person fit for the job is found,i.e defining requirement, attracting potential employees, interviewing and selecting the appropriate person for the job Objectives of recruitment and selection Asda The process of achieving this objective at Asda human resource planning this has to do with describing the job available, person specification and contractual matter. To obtain the quantity and quality of employees required to achieve the objectives of the organization which is being the leading retailer in the UK and Putting customers first in all and behaving with integrity in meeting customers day to day food and service needs.Ensuring that the best candidate is chosen for the job as this will lead to companyà ¿Ã ½s objectives being met as profits will increase. In my organization, they have been able to employ the right kind of people needed to achieve the set objectives as they have an effective and planned style of recruitment which starts from recognizing the need to fill a vacancy with an identified job analyses, job description and person specification and this leads them to communicating and contacting the internal and external labour who may be interested. Internal because sometimes they promote existing staff to fill the vacancy depending on the availability of the skills and attribute required. Sainsburyà ¿Ã ½s To obtain the quantity and quality of employees required to achieve the objectives of the organization which is being the leading small format food retailer in the UK and Putting customers first in all and behaving with integrity in meeting customers day to day food and service needs. Ensuring that the best candidate is chosen for the job as this will lead to companyà ¿Ã ½s objectives being met as profits will increase. Getting the recruitment process right. Very important as the HRM is responsible for this. Money will be lost if the process is done wrong or badly. From those that have applied a selection is made base on the ones most likely to fulfil the requirement of Sainsbury especially with regards to customer relations and this includes reviewing the applications, interviewing among others. for Sainsbury interview tools has helped them to place candidate at ease, because it is face to face , it is interactive and allows them to assess the appearance, inter personal and communication skills. This has enabled them to select employees that have the technical competence and ability to perform certain task, have the potential for training, development and promotion. Because they are customer focused, these process has helped them to identify candidates that are sociable, who can work harmoniously and fit into the cultural and social structure of Sainsbury bearing in mind the importance of compliance with all the legal requirements relating to employment and equal opportunity. They have also been able to archive there set objective through effe ctive recruitment and selection process . 2. Training and development Once a worker joins an organisation, then it would be useful to train and develop the person in order to maximise his/her human recourse potential. They note that due to the ever increasing competition among present day organisation, companies need to have more sophisticated employees. (Gray and Smiltzer, 1989). Objective of training and development Asda In Asda organization, training and development is a manpower strategy linked to the overall strategy, this is done by determining the training needs of the employees thru appraisal, analyses of job e moral requirement and corporate analysis. In Asda the purpose each training is identified and clears, it is usually in-house or thru external arrangements. This trainings are effective because at the end of the training, usually they would distribute end of course questionnaires which measures the reaction of the trainees, interviews are conducted, observations of improvement on job performance made and career development. This you can also see in the enthusiastic spirit among the staff. By training the staff, they are equipped for the task ahead which is giving improved quality service and these means the achievement of target, goals and objectives measured in terms of output, productivity, quality . Sainsbury To update the knowledge of the employee on current legislation To improve skills and qualifications To increase confidence and competence To motivate employees this encourages higher productivity To improve health and safety. 3. Employeeà ¿Ã ½s relation Employee relation is a modern terms alternative user former industrial relation in present time. The culture of organisation is important aspect of employment relation which contributes to the success of an organisation. It is also a mix of beliefs, values, mission, approaches to thinking and understanding. (Daniels, 2006) Objective of Employeeà ¿Ã ½s relation Employees and industrial relation focus on the moral and motivation of employeeà ¿Ã ½s communicating and consulting with staff building up a strong relationship with employeeà ¿Ã ½s representative to make sure that employees are aware that of all decision. Asda In Asda we have strong relation between employee and management. It is the responsibility of HRM department of Asda to make sure the contribution of employees in decision making. Asda is also providing a supervisor to correct the performance of employees. Information that provided to employees is to promote a better understanding of management goals and policies. Sainsburyà ¿Ã ½s Give feedback on the employees work Make salary and promotion decisions as fair as possible Give employees an opportunity to participate in decisions affecting them Allow for career development and training To improve the efficiency of the organization by ensuring that individual employees are performing to the best of their ability and developing their potential for improvement. Task 2 Organisationà ¿Ã ½s structure and culture contribute to HR performance and evaluate referring to two theoretical models. 1. Organisationà ¿Ã ½s structure and culture impact on the management of HR. 2. Models of HRM. TWO HUMAN RESOURCES (HRM) MODELS Two HMR models partial used In Sainsbury 1. The Harvard Framework Model 2. The matching Model of HRM The Harvard Framework Model The other founding fathers of HRM were the Harvard School of Beer et al (1984) who developed what Boxall (1992) calls the Harvard Framework .This framework is based on the belief that the problems of historical personnel management can only be solved when general develop a view point of how they wish to see employees involved and developed by the enterprise and of what HRM policies and practices may achieve those goals .Without either a central philosophy or a strategic vision which can be provided only by general managers.HRM is likely to remain set of independent activities , each guided by its own practice tradition. As also explained earlier we can see that Sainsbury survival and growth have mainly been dependent on the fact that the Harvard Framework is partially followed where in Managers across Sainsbury are being given responsibilities for selecting, motivating, developing and evaluating employees. All managers are therefore taking on human resource responsibilities. Employees are the most important resources in Sainsbury, particularly in creating a competitive edge Managers across Sainsbury are being given responsibilities for selecting, motivating, developing and evaluating employees. All managers are therefore taking on human resource responsibilities. Has Employees are the most important resources in Sainsbury, particularly in creating a competitive edge. The matching Model of HRM One of the first explicit statements of the HRM concept was made by Michigan School (Fombrun et al, 1984).They held that HR systems and the organization structure should be managed in a way that is congruent with the organizational strategy (hence the name matching model). They further explained that there is a further human resource cycle, which consists of four generic processes or functions that are performed in all organizations. The first and the most important among them is Selection à ¿Ã ½matching available human resources to jobs is one among them that has been a key to the success of Sainsbury the reason being that as explained earlier that the Recruitment process are of two kinds external and Internal recruitment and according to the Matching Model Which is largely applied in Sainsbury the Recruitment is done internally by using Internal Job posting and no doubt has been a very successful thing ,has the individuals who are selected already have a hands on experience with the post that they have applied for as they do get trained skills required to fulfill that role by doing multitasking by carrying on doing their work and also learning the skills required for the new job that they are applying for out of their own interest voluntarily. Task 3 Evaluate HR policy in a given organisation. 1. Critically analyse at least three HR policies in an organisation . 2. Recommendations for improvement 1. Critical Evaluation Sainsbury require the assistance of staff to carry out the daily activities related to the nature of the organization. The people are all-important members of staff to Sainsbury and fulfil a key role in its operation. Sainsbury would not be successful without all the sophisticated technology but for human beings are responsible for setting up correctly, pressing the right buttons and repairing it if it malfunctions. Once inside Sainsbury staff performs various duties in connection with their roles and Sainsbury expects their work to be of a satisfactory standard, completed within a timescale and to be cost effective. Training is provided to help employees improve their levels of efficiency and this is rewarded with promotion or a bonus in recognition of their efforts. None of this would occur if the managers had not selected potential workers in a careful way. The skills required can be identified and matched against the abilities of people looking for work. If Sainsbury takes on sta ffs who are unsuitable, it can cause a number of problems, e.g. à ¿Ã ½ Poor productivity levels, à ¿Ã ½ Bad feeling among staff à ¿Ã ½ Dissatisfaction about the job à ¿Ã ½ High level of absenteeism à ¿Ã ½ Customer complaints à ¿Ã ½ Dismissal or resignation à ¿Ã ½ The search for a replacement. In order to avoid issues as above Sainsbury use several methods of evaluating Human Resource Performance. Critical Incident File The use of the critical Incident file is very essential in Sainsbury has staffing time plays a key role in the proper functioning of the store/restaurant , however critical Incident files of different colours are used by managers to make certain entries for different reasons , for example if an employee gets an appreciation from the customer an entry is made under his or her name in a green file and if an employee is late the entry is made in a yellow file and if there is a NCNS (No call no show ) an entry is made in a red file and all the data is gather for the performance appraisal period and used to rate the employee. Human Resource Management should have a person in the organisation who will be in the disguise of a crew member recording the positive and not so positive activities of each individual employee of the organisation which would have immediate and positive effectives if escalated back to the Human Resource Management team in the Head Office. Sounding the Oirish: OBrien versus Synge :: Essays Papers
Sounding the Oirish: O'Brien versus Synge "Synge was perhaps the most monstrous phony and buffeon ever to enter our celtic toilet, but he won international fame and money because foreigners extracted strange meanings and nuances from the language he used." Flann O'Brien was a writer obsessed with both nationhood and language, and saw the two as inextricably entwined. Nowhere was this more apparent than in his writings under the pseudonym of Myles na Gopaleen. One particular target of O'Brien's scorn was J. M. Synge's Playboy of the Western World. O'Brien felt that with the success of Synge's play, the stage-Irishman as he appeared in Dion Boucicault's works of the mid-1800s had become the prime symbol of Irishness (although, it may be argued, both Boucicault and Synge are putting forward a subversive version of the stage Irishman who had been a staple part of English drama for centuries). The main thrust of O'Brien's knife is this: "The set-up is this. These people turn angrily on the British and roar: 'How dare you insult us with your stage Irishman, a monkey-faced leering scoundrel in ragged knee-breeches and a tail coat, always drunk and threatening anybody in sight with his shillelagh? We can put together a far better stage Irishma n ourselves, thank you. The Irish Stage Irishman is the best in the world.'" The pig-in-the-kitchen image of Ireland was, as far as O'Brien was concerned, the main effect of the nationalistic firing of half-cocked muskets. Rather than subverting the English stage Irishman, Boucicault, Synge and their ilk merely augmented its dubious itinerary (I never said that the pro-subversion argument was a winning one). The crippling stroke O'Brien applies to Synge deals exclusively with language: "[T]he worst was Synge. Here we had a moneyed dilettante coming straight from Paris to study the peasants of Aran not knowing a syllable of their language, then coming back to pour forth a deluge of homemade jargon all over the Abbey stage ..." From such jargon has emerged such wondrous entertainments as Darby O'Gill and the Little People, The Quiet Man, and even the recent offerings Far and Away and Waking Ned (add to this truncated role of dishonour umpteen others, and don't forget that amadan in Braveheart). Although Synge may have had subversive intentions, the legacy such work has given us is not subversive at all. Instead it bedecks the politics of colonialism with praties, shillelaghs, and a bottle of the aul' poitin.

Analysis of The Outcasts of Poker Flat by John Oakhurst :: The Outcasts of Poker Flat John Oakhurst Essays
Analysis of The Outcasts of Poker Flat by John Oakhurst John Oakhurst is the main character in ââ¬Å"The Outcasts of Poker Flatâ⬠. John is an outstanding person and has some phenomenal traits. Such as that he is unusually calm, courageous, and modest. John has shown numerous times in ââ¬Å"The Outcasts of Poker Flatâ⬠, that he is an extraordinarily calm person. One time in which Mr. Oakhurst showed extreme calmness is when the men come to take him away, and he just took what is coming. That to me shows extreme calmness. Another time when John Oakhurst shoes his trait of calmness is when he has to walk on foot back to Poker Flat to save Piney. John just said that he would try, and off he went. No worries or second thoughts about it. Those two things to me, show that John Oakhurst is a extremely calm person. John, the gambler, is an extremely courageous person. He has proven this by a number of actions in this story. First of all he shows tons of courage by not getting scared when the travelers and him get snowed in. If it where me I probably would have run off like Uncle Billy did. Another example of when Mr. Oakhurst showed courage was when he kicked Uncle Billy to stop him from laughing. Most people would have just told him to stop laughing. But not Mr. Oakhurst, he just gave him a swift kick in the stomach. That to me shows the utmost courage in the world. Another one of Johnââ¬â¢s traits is that he is overwhelmingly modest. Mr. Oakhurstââ¬â¢s modesty is proven numerous times in this short story by Brett Harte. One of those times is when John puts the death card on the tree, he doesnââ¬â¢t boast about dying while trying to save a life. He simply states that he ran out of luck on a certain day. Another time in which John displayed modesty is when he never boasts of winning all that money during card games.

Anglo-Saxon Values Demonstrated by Beowulf Essay
In Seamus Heaneyââ¬â¢s translation of the epic Beowulf, the protagonist, Beowulf, exemplifies the values of an Anglo-Saxon warrior and king. Beowulf is a Geatish warrior who uses his super-human strength to defend the Danes, a neighboring kingdom, from a terrible monster named Grendel. Beowulf then goes on to kill Grendelââ¬â¢s mother and become the king of the Geats. During his reign, Beowulf runs a successful kingdom and sacrifices his life to save his kingdom from a dragon. Beowulf demonstrates the Anglo-Saxon values of physical strength, a thirst for revenge, and courage, through the manner in which he fights various battles and his motives for fighting them. Beowulfââ¬â¢s extraordinary physical strength is displayed during his battle with Grendel, a powerful monster who has fought and killed many Danish warriors without difficulty. When Grendel tries to sneak up on Beowulf, Grendel discovers ââ¬Å"himself in a handgrip harder than anything he had ever encountered in any man on the face of the earthâ⬠(Beowulf lines 749-752). Physical strength is greatly valued by the Anglo-Saxon culture, and Beowulf is stronger than anything Grendel has ever faced before. Because of his impressive strength, both the Danes and Geats are willing to follow Beowulf into battle and can count on him to lead and protect them. It is evident from Grendelââ¬â¢s struggle that Beowulf surpasses the physical strength of the normal human, making him a model Anglo-Saxon warrior. Along with his immense physical strength, Beowulf is willing to seek revenge to achieve justice. BEOWULFââ¬â¢S BATTLE WITH GRENDELââ¬â¢S MOTHER IS DRIVEN BY REVENGE. GRENDELââ¬â¢S MOTHER SNATCHES AND KILLS A DANE NAMED AESCHERE, WHICH DEEPLY AFFECTS KING HYGELAC, WHOM BEOWULF IS VERY CLOSE TO. BEOWULF TAKES IT UPON HIMSELF TO AVENGE THE DEATH OF AESCHERE FOR KING HYGELAC AND INSTIGATE A BATTLE WITH GRENDELââ¬â¢Sà MOTHER IN THE NAME OF JUSTICE. BEOWULFââ¬â¢S BELIEF THAT ââ¬Å"IT IS ALWAYS BETTER TO AVENGE DEAR ONES THAN TO INDULGE IN MOURNINGâ⬠REPRESENTS THE BELIEFS OF MANY ANGLO-SAXON WARRIORS. (BEOWULF LINES 1384-1385). IN ANGLO-SAXON CULTURE, GRIEVING OVER ONEââ¬â¢S LOSSES IS DISCOURAGED. IF AN ANGLO-SAXON WARRIOR IS WRONGED, THEY ARE OBLIGATED TO SEEK VENGEANCE AND BE WILLING TO INSTIGATE BATTLES IN ORDER TO BE A SUCCESSFUL AND RESPECTED WARRIOR OR KING. BEOWULF LIVES UP TO THE SOCIAL NORMS OF ANGLO-SAXON SOCIETY AND MANAGES TO MAINTAIN HIS HEROIC REPUTATION BY ATTEMPTING TO KILL GRENDELââ¬â¢S MOTHER AS AN ACT OF REVENGE. A BATTLE FOUGHT IN THE N AME OF REVENGE HAS THE POTENTIAL TO SHOWCASE A HEROââ¬â¢S TALENT AND DRIVE THEM TO FAME, BUT THAT THIRST FOR REVENGE IS AN EMPTY THREAT WITHOUT COURAGE TO BACK IT UP. Beowulf reveals tremendous courage in each of his battles, but exceptional fearlessness is displayed in his fight against a dragon to defend the people of his kingdom. Beowulf is very old at the time of this battle, so he knows the chances of him being able to defeat the dragon and survive are slim. Despite the unlikelihood of his victory, Beowulf still chooses to fight, and tells his men,â⬠this fight is not yours, nor is it up to any man except me, to measure his strength against the monster or to prove his worth. I shall win the gold by my courageâ⬠(Beowulf lines 2532-2536). As king, Beowulf abides to the norms of Anglo-saxon culture and feels that he must be the one to lead his men to battle no matter what the cost. All of Beowulfââ¬â¢s warriors, except Wiglaf, abandon him when he needs them most during the battle, out of fear for their lives. Beowulf and Wiglaf are the only ones with the courage to continue fighting the dragon even when the odds are working against them, proving that they alone have the values of a true Anglo-saxon warrior. Throughout Beowulfââ¬â¢s life he earns his place as a devoted and successful Anglo-Saxon warrior because he demonstrates their values not once, but three times. In each of his battles, Beowulfâ⬠s actions portray the key Anglo-Saxon values of immense physical strength, the right to seek revenge, and courage. By observing the manner in which Beowulf fights his battles, one can conclude that in order to be a respected Anglo-Saxon leader and warrior one must possess all of these qualities. Leaders today exemplify traits theà people of society value, which allow the leaders to gain the trust and admiration of others, just as Beowulf did. This is evident in the protagonists we choose for our literature and the people we choose to lead us. For example, selflessness is highly valued in todayââ¬â¢s society, and a major literary hero, Superman, shows this characteristic by fighting evil to save others without concern for himself. Beowulf and leaders today are able to achieve respe ct and power because they embody the traits admired by the people of their time.

In What Ways and with What Results Did 19th Century Nationalism?
During the 19th century, nationalistic thoughts began to infiltrate Europe, which eventually lead up to unifications, as well as the First World War. Nationalism began as each ethnicity began to feel a sense of individuality and identity. Nationalism was the start of independence and revolutions, even after the Congress of Vienna, which sought to continue conservative ways. With the rise of nationalism in the 19th, it catalyzed many wars including World War One.At the beginning of the 19th century, the Congress of Vienna was a reaction to the French Revolution, in which they wanted to preserve the monarchies in Europe as well as conservative ways. Nationalistic ideas were surfacing across Europe however the Congress of Vienna did not prevent the nationalism uprisings of 1848. By combining the Netherlands with Belgium, and continuously not giving Poland itââ¬â¢s freedom, the Congress only furthered the nationalistic movements. Revolutions began to take Europe during the year of 184 8, the year of Revolutions.Up until then, different ethnic groups began to pride themselves in nationalism, and in their identities. Countries such as Poland, Belgium, Italy, and Germany started revolutions in order to gain independence. Each country was fighting for nationalism with their new sense of identity however many of them failed. Nationalism ultimately caused the independence of countries such as Germany and Italy. It encouraged people of each state to think about their ethnicity as well as identity. Even though many states benefited, other states were suppressed and unable to break free. This is one of the factors that led up to the First World War. As the Ottoman Empire began to decline, it was right in the 19th -20th century, which was the prime time of nationalism. States wanted freedom from their reigning countries due to their national pride, yet the reigning countries were uncooperative. The Balkan areas were under the Austria-Hungary Empireââ¬â¢s rule, yet Serbia wanted to create a new country with states that mostly contained Serbians. Their nationalism became ultra-nationalistic which led to the assassination of the crowned prince of Austria-Hungary.This was one of the reasons of World War I starting up-nationalism. The seed of nationalism in Europe not only created many new independent nations but also created a sense of identity within states. Without nationalism uprisings in Europe, many of what the world looks like now would not be here and unified countries such as Germany and Italy may still be tiny states instead of a large country. Nationalism shaped Europeââ¬â¢s geographical state, and the course of events that led up to the 20th century.

Ethics in Professionals Essay
. Salgo v Leland Sanford University Board of Trustees notes that if the health professional do not present all the necessary facts that will form the basis for the decision of the patient, the professional has committed a violation. The patient has to undergo an operation in the heart, in his aorta. Before the operation, he is well. After the operation, the patient experienced paralysis in his lower extremities and that the condition is permanent. There has been negligence in the part of the doctors and they fail to explain to the patient all the details of the procedure (Standford 1957). 2. Arato v. Avedon states that the physicians must present the accurate statistics regarding the life expectancy of patients regarding their case so they could plan for their death. Arato was suffering from an illness in his pancreas. He was told by the doctors to undergo F. A. M. chemotherapy. The doctors have failed to give the patient the chances of recovering after the chemotheraphy (LSU Law Center 1993). 3. The Schloendorff case has been part of the history of informed consent when the concept was made upon the decision of the judge that adults and those who are capable of thinking well can determine what can be done to his body and that any professionals who work on a patientââ¬â¢s body without the latterââ¬â¢s consent is guilty of assault and is liable of any charges. It says that as long as the patient is capable of right thinking, he can give his consent regarding the operation to his body. The victim has some problems in her stomach. When she was under anesthesia, the doctor performed removal of fibroid tumor. The patient only gave her consent to have ether examination. After the operation, the patient has to be amputated because of infection and gangrene (Szczygiel). 4. Canterbury v. Spence also states that all information regarding the result, the risks, benefits of the operation must be revealed to the patient. The patient was suffering from back pains. The doctors performed an operation which resulted in paralysis. The doctors failed to disclose the risks of the operation (Stanford, 1972). 5. The Patient Self-Determination Act provides a document of the rights of the patients to participate in making decisions for their own safety and make directives. It also says that violation of it makes the health professionals ethically liable. B. Timeline Schloendorff case (1914) ? Salgo v. Leland Sanford University Board of Trustees (1957) ? Canterbury v. Spemce (1972) ? Arato v. Avedon ? Patient Self-Determination Act (PSDA) (1991) C. Informed Consent Informed Consent involves the participation of the patient regarding the decision to whether a procedure will be done to the patient or not. The patient has the right to give consent. Informed consent means that the patient is informed regarding all the information that is necessary for the patient to have a basis in making his decision. Information includes the status of his illness, the life expectancy, the treatment that could be done and its risks and benefits, and all other possible treatments. The patients must also be informed to the possible consequences of not performing the treatment or even the consequences if the treatment is performed Works Cited: LSU Law Center. 1993. Malcolm X and Martin Luther King Jr. Essay
Both Martin Luther King Jr. and Malcom Little, better known as Malcolm X were major figures in the civil rights movement in the United States. Despite fighting for the same cause, which is to see that all individuals in the United States are indeed equal regardless of race, both men take a different approach in furthering the cause. They both decried the injustice committed against the black people by the whites and wanted to see it come to an end. It was for this reason that the civil rights movement gained momentum in the 1960ââ¬â¢s. The most obvious difference is the stance they took in pursuing their goal. Little, who became Malcolm X after converting to Islam, puts emphasis on self-empowerment among the black people, as well as other racial groups in the US for that matter; that they should use any means necessary to win their freedom and equality if society would continue to marginalize them. In trying to understand why Malcolm X was rather militant in his appraoch to the point of being ââ¬Å"nationalistic,â⬠one has to understand that he was born and raised in a ghetto where life was rough which resulted in the murder of his father and his mother committed to a mental institution. In as much as he deplored the racists, he also deplored whites who pretended to sympathize with them and pay lip service to their support of their cause. It is for this reason why he wanted thje blacks to empower themselves because he felt nobody will do it for them (Breitman, 1965, p. 26). King was brought up in a well-to-do family in spite of their race and he ââ¬Å"borrowedâ⬠the approach taken by Mahatma Gandhi of nonviolent resistance as the means to accomplish their goal owing to his avocation as a minister who eschewed violence. King agreed with Gandhiââ¬â¢s principle that the oppressors need to see the evil they are committing to make them stop; for to fight back would make them further justify their actions. If Malcolm X were to have his way, he could have dragged America to another civil war, especially if he intended to use Islam as a vehicle to advance his cause, whereas King used a combination of Christian faith and Gandhiââ¬â¢s teachings which is compatible to the former (Vander Lei & Miller, 1999, pp. 84-85). Both men were assassinated for they were seen as a threat by their opponents. In the end, the civil rights movement was successful when the government passed a series of laws that once and for all ended segregation. The impact was not immediate and its effect was felt gradually through the passage of time and the proof that it was successful was evident with the election of Barack Obama as President of the United States. And if one were to ask who would get the credit, the most likely answer would be Martin Luther King Jr. and his Gandhi-

Summary of a book chapter - Assignment Example The terrorists undergo various training that are well discussed in this chapter. They include, disguise techniques, clandestine travels, recruitment, communications, handling of weapons- including bombs and explosives, assassination and ambush techniques and even collection of intelligence and counterintelligence methods. Terrorists go to training camps to acquire particular tactics and gain proficiency in a variety of skills. They are taught how to handle and execute terror plans in target states and nations. Such training is usually of a wider array of tactics than that of the counterterrorism police forces. For example, training on Arson and bombs. Terrorist are taught on how to make and use explosives and incendiary bombs. They are provided with guidelines and instructions on how to operate these explosive devices in training camps. Teachings on the incendiary type of weapons give terrorist insights on how to make simple fire bombs using locally available materials such as bottles and inflammable mixture attached to a fuse. In the latter days though, they are taught how to make plastic bombs from plastique that are sophisticated explosives and not readily detectable by most modern airport security. These training camps equip terrorists with assassination and ambush techniques usually how to penetrate through security systems and kill at close range. Methods of clandestine approach, disguise and escape are incorporated with handling and use of handguns fitted with silencers. Such kind of training enabled the assassination of former Pakistani Prime Minister Benazir Bhutto in 2007. Another training is on how to raise money through extortion and kidnapping for ransom from wealthy families and employers. It is usually a little risk, but high-profit operation. These terrorists are also trained in recruitment, counterintelligence, and communication. Such training gives them proficiency in acquiring intelligence on
